
The Los Angeles City Council Wednesday unanimously approved a nearly $400,000 settlement for a man who spent 13 months behind bars before being acquitted of murder.
Roy Galvan was arrested on March 1, 2011 for the shooting death of Joey Gutierrez on Jan. 28 of that year, but was acquitted of the killing in April 2012.
Galvan sued in 2014, claiming that two members of the Los Angeles Police Department, Detective Miguel Terrazas and Officer David Nunn, fabricated and withheld evidence and also bribed witnesses in the case.
A spokesman for Los Angeles City Attorney Mike Feuer had no comment on the settlement, and an attorney for Galvan did not respond to a request for comment.
The city did not admit any wrongdoing in settling the case.
At the time of the shooting, Galvan was recovering from ankle surgery and would have been unable to flee on foot from the scene, as one witness claimed the shooter did, because he was using crutches, according to his court papers. Galvan said he was home with his daughter when the shooting occurred near Main Street and 43rd Place.
Terrazas was an officer at the time of Galvan’s arrest but was promoted to detective in October 2012. Both he and Dunn are still employed by the LAPD.
